Terms and Conditions

By accessing or using My Porch Front Bakery, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the service.

You must be at least 18 years old, or the age of legal majority where you live, and able to enter a binding agreement. If you use the service for a business or organization, you represent that you have authority to bind it to these Terms.

My Porch Front Bakery helps customers discover independent home bakeries, submit pre-orders, receive updates, and communicate with bakery owners. Each bakery independently prepares and sells its goods, sets its menu and prices, chooses whether to accept an order, arranges pickup, chooses its accepted payment options, and remains responsible for its customer relationships.

We are not the maker, seller, owner, or distributor of a bakery’s food and are not a party to the food sale between a customer and bakery. Bakeries are independent businesses, not our employees, agents, franchisees, or partners. We do not control their kitchens, ingredients, preparation, packaging, pickup experience, or day-to-day compliance.

You must provide accurate information and keep it current. You are responsible for activity under your account and for keeping sign-in and guest-order links private. Tell us promptly if you suspect unauthorized access.

Customer accounts are optional. A guest receives a private way to view and manage the guest order. Anyone with access to that email or order link may be able to access the order, so do not forward it to someone who should not have access.

Submitting an order is a request to the bakery, not an acceptance by the bakery. An order becomes accepted when the bakery confirms it. Bakery availability, capacity, pickup windows, and menu items may change before confirmation.

The confirmed order describes the goods, quantity, price, pickup date, and other details agreed between the customer and bakery. Customers and bakeries are responsible for reviewing those details and promptly raising any error through the service.

A customer may request or complete cancellation when the order controls allow it. A bakery may decline or cancel an order, including because of capacity, ingredient availability, safety, or an inability to fulfill it. If an integrated payment was already captured, cancellation starts a refund of the remaining paid amount. Refund timing depends on Stripe and the customer’s financial institution. Other payment methods remain the bakery’s responsibility under its stated policy and applicable law.

A bakery may offer Stripe-hosted card or wallet checkout, a separate payment link, or payment at pickup. For integrated checkout, payment is captured before the bakery confirms the order and is routed to the bakery’s connected payout account, less the disclosed online payment fee. Stripe collects payment details directly.

Integrated payments may be fully or partially refunded. We may manage disputes and chargebacks with Stripe and may request information from the customer or bakery. Refunds for payments made outside integrated checkout must be arranged with the bakery and the chosen provider.

Bakery owners may enable online checkout by setting up a connected Stripe payout account. The bakery owner must provide accurate information, remain authorized to act for the bakery, complete required verification, and follow the agreements that apply to that Stripe account. Stripe collects sensitive identity and payout details directly.

The disclosed online payment fee is 7% + $0.30 for Starter bakeries and 5% + $0.30 for Pro bakeries, deducted from the bakery payout. It will not be added as a customer surcharge. The rate shown when a payment begins is retained for that payment even if the bakery changes plans later.

Bakery subscriptions, add-ons, or other paid service features are subject to the price, billing period, renewal, cancellation, tax, and refund terms shown when they are purchased. Payments for service plans are separate from customer payments to a bakery.

Food may be prepared in a home kitchen and may be subject to cottage-food or similar rules that differ from those for a restaurant or commercial kitchen. Customers should review the bakery page and ask the bakery any questions that matter to their decision before ordering.

Ingredient, dietary, and allergen information is supplied by the bakery. Listings may be incomplete, recipes or suppliers may change, and cross-contact may occur. A filter, label, or bakery statement is not a medical guarantee that food is safe for a particular allergy, intolerance, or dietary need. Customers with a food allergy or other serious concern should contact the bakery directly and make their own decision about whether to order or consume a product.

Bakery owners are responsible for:

• following all laws and rules that apply to their business, food, labeling, sales, taxes, permits, and pickup location;
• maintaining any required licenses, registrations, insurance, training, or permissions;
• providing accurate, current information about goods, prices, ingredients, allergens, dietary claims, availability, and pickup;
• preparing, storing, labeling, packaging, and handing off food safely;
• accepting only orders they can reasonably fulfill and communicating changes promptly;
• keeping customer information private and using it only for the order, communication, recordkeeping, or another lawful purpose; and
• handling payments, taxes, cancellations, complaints, and refunds as required by their policies and applicable law.

Customers are responsible for:

• providing accurate contact, order, payment-status, and pickup information;
• reviewing the bakery’s product, ingredient, allergen, payment, pickup, cancellation, and refund information;
• paying the bakery as agreed and not falsely marking a payment as sent;
• arriving within the confirmed pickup window or promptly arranging a change with the bakery;
• communicating respectfully and using order information only for the transaction; and
• complying with applicable law and the reasonable safety or pickup instructions provided by the bakery.

You retain ownership of photos, descriptions, messages, and other content you submit. You grant My Porch Front Bakery a non-exclusive, worldwide, royalty-free license to host, store, reproduce, format, display, and distribute that content as reasonably needed to operate, improve, and promote the service and your public bakery listing. This license ends when the content is deleted, except for copies retained for legal, security, backup, or completed-transaction purposes.

You represent that you have the rights needed to submit your content and that it is accurate, lawful, and does not violate another person’s rights. We may remove content that violates these Terms or creates legal or safety risk.

A displayed credential or verification status means only that information or documentation was reviewed under the process available at that time. It is not an endorsement, inspection of a kitchen, guarantee of continuing compliance, or promise about the quality or safety of any food or bakery.

By using the service, you agree to receive operational emails needed for sign-in, orders, payment-status changes, cancellations, pickup, security, support, and messages between a customer and bakery. The service may send a message by email on the sender’s behalf. Do not use messaging for spam, marketing without consent, harassment, unlawful content, or information unrelated to a legitimate bakery or order conversation.

You may not:

• break the law, infringe rights, mislead others, impersonate someone, or submit fraudulent orders or listings;
• sell prohibited goods or use the service for activity unrelated to legitimate bakery discovery and pre-orders;
• harass, threaten, discriminate against, exploit, or endanger another person;
• collect, scrape, or use customer or bakery information for unauthorized purposes;
• probe, bypass, disrupt, overload, or interfere with the service or its security;
• upload malware or use automated access without our written permission; or
• help another person do any of the above.

We may review reported activity, remove content, limit features, suspend or close an account or listing, cancel access, or cooperate with lawful authorities when we reasonably believe it is necessary to protect the service, enforce these Terms, address fraud or safety concerns, or comply with law. We may take urgent action without advance notice when reasonably necessary, but will provide notice when practical and legally permitted.

We may add, change, suspend, or discontinue features. We do not guarantee uninterrupted availability or that every order, message, or email will be accepted, delivered, or fulfilled. You may stop using the service at any time. Provisions that by their nature should continue after termination will remain in effect.

To the fullest extent permitted by law, the service is provided on an as-is and as-available basis. We disclaim implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant a bakery, customer, listing, credential, product, ingredient claim, pickup arrangement, payment, message, or transaction.

Nothing in these Terms excludes a warranty or consumer protection that cannot legally be excluded. Your rights may vary depending on where you live.

To the fullest extent permitted by law, My Porch Front Bakery and its owners, personnel, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or opportunities arising from the service, a bakery, food, pickup, payment, message, or transaction.

To the fullest extent permitted by law, our total liability for claims arising out of or relating to the service or these Terms will not exceed the greater of the amount you paid directly to Cire Studios LLC through My Porch Front Bakery for the service during the 12 months before the event giving rise to the claim or $100. These limits do not apply where prohibited by law or to liability that cannot legally be limited.

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Cire Studios LLC and its owners and personnel from claims, losses, liabilities, and reasonable costs, including legal fees, arising from your content, your business or food, your transaction or interaction with another user, your violation of law, or your breach of these Terms. This obligation does not apply to the extent a claim results from our own unlawful conduct.

Before starting a formal dispute with My Porch Front Bakery, please email us with a description of the issue and the relief requested. Both sides agree to make a good-faith effort to resolve the issue informally for 30 days. This does not prevent either side from seeking urgent relief or using a small-claims process when available.

These Terms are governed by applicable law, without overriding any mandatory consumer protections that apply where you live. Any claim may be brought in a court that has lawful jurisdiction over the parties and dispute.

These Terms and the Privacy Policy are the entire agreement between you and Cire Studios LLC about My Porch Front Bakery, except for additional terms presented for a paid feature. If a provision is unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will continue. Our failure to enforce a provision is not a waiver. You may not transfer your rights under these Terms without our consent; we may transfer ours in connection with the operation or ownership of the service.

We may update these Terms. We will post revised Terms here and update the effective date. Material changes will receive additional notice when required by law. Continued use after the revised Terms take effect means you accept them.
